PRICING AND AVAILABILITY

Unless otherwise expressed in writing by Benissence, prices for all Benissence Products are as noted on Benissence Site as in effect on date your order is placed. Unless otherwise indicated on Benissence acknowledgment and/or invoice, Buyer shall pay, and be exclusively liable for, all costs of shipping, delivery, insurance and the likes after Benissence has affected delivery of the products to the U.S. postal Service or other carrier. All prices are in United States dollars.

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, we will treat the order as canceled. If you cancel and you have already paid for the goods, you will receive a full refund if the item has not been shipped.

TAXES

Prices do not include any tax or other governmental charge, or assessment of the sale, shipment, production or use of any products sold to the Buyer hereunder. Such taxes and charges, when applicable, may appear as separate additional charges on Benissence acknowledgment and/or invoice. ORDER ACCEPTANCE

You may place orders for Benissence Products and Services through the Service. Your receipt of an electronic or other form of order confirmation does not constitute Benissence’s acceptance of your order, nor does it constitute confirmation of Benissence’s offer to sell you the Benissence Product or Service. Benissence reserves the right at any time after receipt of your order to accept, decline, or limit your order for any reason. We may not accept your order (1) if an item you have ordered is out of stock (2) we are unable to obtain authorization for your payment (3) we suspect fraudulent activity or violation of these Terms and Conditions or (4) if we identify a product or pricing error. 

Your credit card will not be charged until Benissence has accepted your order and prepared your order for shipment. We may require additional verification or information before accepting any order. The price and availability of Benissence and Services offered on the Site are subject to change without prior notice. To the extent we provide information on the availability of any Benissence Products, such information may be subject to further verification by you. Benissence will not be liable for any lack of availability of Benissence Products you may order. If for some reason we are unable to fulfill your order, we will contact you by email or telephone.

BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

PAYMENT

If you order products, you agree to pay at the time of order the then-current applicable fee or price per product and any applicable charges displayed at the time of checkout. You confirm that the credit or debit card that is being used is yours.

SECURITY

The purchase area of the Service is secured. However, if you experience fraudulent use of your credit card because of shopping on Benissence website, notify Benissence and your credit card company in accordance with its reporting rules and procedures. In no event shall Benissence be liable or responsible in any way for the fraudulent use of your credit card.

SHIPPING

We ship from Virginia, so your standard delivery time is 2-7 days after you place your order, depending on where in the U.S. you are located.

SHIPPING CONFIRMATION

You will receive an email confirmation once your order has been successfully placed, which will include your order number. Please make sure your shipping address is correct as we are unable to redirect products once they have been shipped.  Once your order is prepared for shipment you will receive a shipping confirmation email with your tracking information. 

SHIPPING PROCESSING TIME

Orders are processed during business hours, Monday to Friday, from 9am to 5pm Eastern Standard Time, excluding major holidays. Once your order is placed, please allow 2-3 business days for processing. After your order is processed, you will receive a shipping confirmation email with tracking details. Depending on the shipping method and your location, delivery may take anywhere from 2 to 14 business days. Please note that during periods of high demand, such as promotions or major holidays, processing times and delivery windows may be extended.

SHIPPING RATES

The rate for shipping your order is charged based on the weight and your location. Expedited options are available. Should you need expedited shipping, please contact us by email. 

INSPECTION BY BUYER

Buyers shall carefully inspect all deliveries of Benissence  products when received and report by email any alleged error, shortage, defect or non-conformity of such products to within five (5) days after product is delivered. Failure to inspect and report any complain after 5 days shall constitute a waiver by Buyer of any claim or right of Buyer against BENISSENCE arising out of or related to any such error, shortage, defect or non-conformity that was reasonably discoverable by such an inspection.

INTERNATIONAL ORDERS 

When you place orders from anywhere outside the US, your card will be charged in US dollars but remember your financial institution will transfer money to our store in US dollars. The financial institution will manage any necessary conversions. Please see our shipping and return policy for more details on international orders.

INTERNATIONAL SHIPPING 

We ship internationally with a few exceptions. If your delivery address is outside of the United States of America, you may be subject to import duties and taxes, which are charged once a delivery reaches your destination country. Please note that you, the buyer, are responsible for any VAT, tariff, duty, taxes, handling fees, customs clearance charges, etc. required by your country for importing consumer goods. You should note that customs policies and practices vary widely from country to country. We recommend that you contact your local customs office for information. Please note that cross-border shipments may be subject to opening and inspection by customs authorities. You must therefore comply with all the laws and regulations of the country to which the goods are being delivered.

International delivery may take up to 14 business days or more due to the delays from customs clearance.

Please note: Due to technical limitations, we are unable to edit, change or cancel an order once it has been placed. We apologize for this inconvenience.

BACK ORDERS

If an item goes on back order, we will ship you the part of your order that is in stock. When the item becomes available, we will ship you the rest of your order. You will not be charged any additional shipping and handling for the second shipment.

DAMAGES AND ISSUES 

Once an order has left Prestige Plus Limited Liability Company, it is in the care of our trusted shipping carrier. We are not liable for any errors made by the service provider such as product damage or loss during shipping. If you receive your order damaged, please contact us immediately within 24 hours via email sending us pictures and a brief description of the damage(s). We will contact the shipping carrier to file your claim. Please save all packaging materials and damaged goods. We will work to ensure the issue is resolved quickly.

EXCEPTIONS /NON-RETURNABLE ITEMS
Certain types of items cannot be returned, like perishable goods, custom products (such as special orders or personalized products) and some skincare products (such as liquid products). Please get in touch if you have questions or concerns about your specific item before returning.
Unfortunately, we cannot accept returns on sale items or gift cards. Also, we do not accept returns from international purchases.

EXCHANGES
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item. 

CHANGE OF MIND 

You may return the unopened product in its original condition and packaging if you change your mind. The cost for returning the product is your responsibility. You must notify us of the order cancellation in writing (via email).

RETURNS

We want you to be completely happy shopping with us online. If you are not satisfied with your purchase, you may return it within 14 days (the “Time Limit”) after receiving the product for exchange or store credit. Only items purchased on www.benissence.com with correct order information will be accepted for return.  
To be eligible for a return, your item must be in the same condition that you received it, unopened or unused, with tags, and in the original packaging condition with any retail seals unbroken. When returning your item, you’ll also need the receipt or proof of purchase, a copy of your contact information including name, address, email, and phone number.

To start a return, you can contact us at info@benissence.com If your return is accepted, we’ll send you instructions on how and where to send your package. If you have received a gift with the purchase, you must return the gift along with your purchased product. If both the purchased product and accompanying gift are not returned, your return will not be accepted. 

You will be responsible for paying the shipping costs for returning your item. We don’t guarantee that we will receive your returned item.  To ensure delivery we recommend you use a trackable shipping service. Items sent back to us without first requesting a return will not be accepted.

Your returned item must be received and examined to get store credit or exchange. We will notify you once we have received and inspected your return. If approved, an exchange or store credit will be issued. If you receive an incorrect item, you will be refunded the full postage cost, otherwise customers are responsible for shipping fees (shipping costs are non-refundable). Store credit or exchange will not be approved If the parcel is destroyed by you or the courier service.

We expressly reserve the right to refuse returns that do not fully comply with our return policy. Returns are at the discretion of Prestige Plus Limited Liability Company

These Terms will be governed by and construed in accordance with the internal laws of Virginia without regard to conflicts of laws principles. By using this site, you hereby agree that all disputes regarding these Terms will be subject to the courts located in Richmond Virginia. These Terms and Conditions operate to the fullest extent permissible by law.

The failure of Benissence to comply with these Terms because of an act of God, war, fire, riot, terrorism, earthquake, actions of federal, state or local governmental authorities or for any other reason beyond the reasonable control of Benissence, shall not be deemed a breach of these Terms.

If Benissence fails to act with respect to your breach or anyone else’s breach on any occasion, Benissence is not waiving its right to act with respect to future or similar breaches.

If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions.
